Had the car a few weeks now, the stop start has never worked.
Should I take it back or am I doing something wrong?
It's only 12 months old so it can't be the battery

It actually might be the battery. If not, it's possible that the previous owner have disabled it through ddt4all.

I wouldn’t worry about it at the moment, there are a lot of variables that are needed for the start/stop to work, including engine temp, battery voltage and load upon the system to name a few.
If you are only doing short runs, it quite possibly will not activate, the car needs to be driven a good long round trip to get everything charged up, and even then it still may not work as the engine temp and outside temp may be unsatisfactory.
Whilst you may find the German marquee of this world operate more often, this is reflected in the price of the vehicle and more often they are fitted with auxiliary hardware such as an extra lithium stop/start battery and electric engine water pump, to keep the flow of water around the engine will it’s stopped.

If you have a battery charger you could try a charge then get the car up to working temp and see if it works to try it.
